Permanent Visa
This type of visa is for lawfully operating Australian employers to sponsor highly skilled workers in particular occupations that cannot be filled from within the Australian labor market.
The Employer Nomination Scheme (ENS) allows Australian employers to sponsor employees who are foreign nationals like you for a permanent visa to work in Australia. The ENS enables employers to sponsor highly skilled workers to fill relevant full time vacancies, as long as the position is for at least three years and it meets minimum salary level guidelines.
Summary of ENS migration requirements
The ENS has been developed for Australian employers to recruit permanent, highly-skilled staff from overseas, when they have been unable to fill a vacancy from within the Australian labour market or through their own training programs.
The ENS process has two stages:

General details of the process are given below.
1. Requirements for an employer
In brief, an employer must be able to demonstrate that:
- they have a need for a paid employee, that the business is located in Australia and that it is operated by the employer
- the vacancy requires the appointment of a 'skilled person'
- if applicable, the skilled person is eligible for any mandatory licensing, registration or professional body membership where required;
- the position is a full time, fixed-term appointment of at least 3 years, which does not exclude the possibility of renewal
- the employer has a satisfactory training record, or for a new business, must make satisfactory provision for future training
- the employer must have demonstrated that the position cannot be filled through the Australian labour market, unless the position is on the Migrant Occupations in Demand List (MODL); and
- the terms and conditions of employment must be in accordance with the standards for working conditions provided under Australian industrial laws.
2. Requirements for visa nominee
In general terms, the visa application will be assessed against the following:
- the nominee has the skills relevant to the nominated position
- the nominee meets the definition of a 'skilled person'
- the nominee is able to satisfy any mandatory licensing, registration or professional membership requirements
- the employment as outlined in the approved nomination is still available
- the nominee is less than 45 years of age
- the nominee has vocational English language ability; and
- the nominee and all family unit members meet mandatory health and character requirements.

What does this visa let me do?
This visa allows you and any dependent family members included in your visa application to live as permanent residents in Australia.

Visa options for doctors
A number of temporary or permanent work visas are available for general practitioners or specialists.
The preferred temporary visa option for doctors is the Temporary Business (Long Stay) (Subclass 457) visa, which allows employers to sponsor multiple doctors to work in Australia under one sponsorship agreement.
Alternatively, doctors can apply for the Medical Practitioner (Temporary) Subclass 422 visa, which requires employers to lodge a separate sponsorship application for each doctor sponsored.
Doctors must hold full medical registration to apply for permanent residency. Registered doctors can apply for permanent visas as under the Employer Nomination Scheme and Regional Sponsored Migration Scheme, or Labour Agreements.
Visa options for Nurses
Both permanent and temporary visas are also available for nurses.
Registered nurses sponsored by an employer can apply for the Temporary Business (Long Stay) (Subclass 457) visa. Permanent visas are available under the Employer Nomination Scheme or the Regional Sponsored Migration Scheme. · has an employer that is willing to sponsor them for this visa.

Applying for ENS Visa
If the employer and employee are eligible, willing and able to meet their obligations under the Employer Nomination Scheme, they can commence the 2-step application process.
Step 1 - Employer nominates a position
The employer must nominate the position to be filled.

2 - Employee applies for a visa
The employee must apply for a visa to work in Australia using employer nomination.
Successful ENS Visa applicants will be granted Australian permanent residence (PR) under this Visa type. As a permanent resident; you have the right to live, work and study in Australia for as long as you wish. When you are granted permanent residence, a Visa label is placed in your passport as proof of your permanent residency.
