Provincial Nomination Program

Required:
· Offer of employment – BIGGBIZ MANAGEMENT help to get employment nomination

· Joint submission of visa application with employer

· Background checks

This program permits most Canadian provincial governments to play a direct role in the selection of immigrants who wish to settle in their province. If you wish to take part in this program, you will need to follow a three-step process.

Step 1 – Offer of Employment

You will need an offer of employment (from provincial) in an area of critical shortage which has been identified by the province you wish to migrate to. FEMRA INDIA can help to obtain you a job offer by using our partnerships with direct employers associations and job agencies in Canada.

Please note: Each province in Canada has similar nomination programs with slight variations. The particular visa type and province that you may qualify for will depend on your own qualifications, skills and experience. After receiving your completed assessment form we will advise you as to the most appropriate visa to your situation.

Step 2 – Provincial Applicatio

This step requires that a joint application is submitted with details of you and your future employer to the relevant provincial department. This application documents your offer of employment and requests the provincial governments’ approval of it. If you meet all of their requirements and you genuinely intend to settle in that province, you will be selected for the program. Citizenship and Immigration Canada (CIC) will be notified by the province of your selection.

Step 3 – Federal Application

Successful Provincial applicants can now apply to CIC for permanent residence. You will need to undergo medical, security and criminal background checks before your permanent residence status is approved.

CIC could take up to 12 months to make their decision. Most Canadian provinces will therefore support your application for a temporary work permit. This will enable you to take up your new position in Canada, while awaiting permanent residence.

The Canadian Federal government has also negotiated various provincial and territorial agreements relating to the specific needs of employers and capital investment for each geographic area. Therefore, most Canadian provinces also have their own nominee programs that are designed to encourage skilled migrants to settle in those provinces. Currently, Provincial Nominee Programs exist in the following provinces and territories:

Alberta
Manitoba
Newfoundland and Labrador
Prince Edward Island
Yukon
British Columbia
New Brunswick
Nova Scotia
Saskatchewan

Under the various Provincial Nominee Programs, the participating provinces seek to attract skilled migrants under agreements with the Government of Canada.

Canada is one of the most popular immigration destinations in the world and has one of the largest foreign born populations of OECD countries. Most immigrants come to Canada as skilled migrants -- either as temporary foreign workers, permanent residents under its various scheme, or as provincial and territorial nominees.

The Provincial Nominee program allows provinces and territories to nominate migrants who will live and work in Canada and receive Canadian permanent residence visas. Provincial Nominee applications are given preference over other skilled visa applicants by Citizenship and Immigration Canada (CIC).

In general, there are two ways you could immigrate to Canada as a Provincial Nominee: either as a skilled worker with a job offer or as a business entrepreneur. Some provinces and territories have additional variations on these basic categories. For instance, in addition to an entrepreneur category, the Newfoundland and Labrador Provincial Nominee Program has the Immigrant Partner category which allows up to three migrants to come under the nominee program if they will partner together in a business.

In the case of Ontario, there is the Employer category for employers who wish to hire foreign skilled workers and the Multinational Investor Category, which is meant to aid companies planning to make major investments in Ontario by fast-tracking work permits and permanent residence visas for key personnel.

In most cases, an employer wishing to hire you under the provincial nominee program can state their case for hiring foreign talent to the provincial government. Once approved, they can then have you apply for permanent residence under the Provincial Nominee Program.

CIC then makes a final decision on your application.

Benefits of Provincial Canadian Immigration

Many people opt for a Provincial Nomination scheme visa as in some cases it provides a quicker route to Canadian immigration and gives the holder the option to apply for Canadian Citizenship. The benefits of this visa scheme are that successful applicants can enjoy the same benefits as those who hold a visa under federal skilled worker program.

If the application becomes successful the applicant will be able to live and work in Canada and will be granted permanent residency. There are certain factors that are taken into account when an applicant is being assessed they include age, education qualification and crucially, adaptability, no points system such as that employed in the federal skilled migration is used. Candidates do not have to meet a minimum points entrance as part of this assessment however the applicants suitability to relocate to the province in question will be carefully assessed.

Understanding Provincial Nomination Programmes (PNP)

Not all Canadian Provinces offer PNP  The majority of Canada's provinces have arrangements with the Federal Government which enables them to make a direct contribution to the immigration process. Provincial Nominee Programmes give some power to the provinces to influence which candidates are permitted to settle in the province.

Candidates need to go through three stages when applying under this visa scheme. The first stage requires applicants to have an authentic offer of employment from a Canadian company based in the province based in the province to which the applicant intends to immigrate. Secondly, any offer of employment must be approved by the relevant provincial government and the application will be assessed against the immigration need of the particular province. Applicants will also need to establish a strong case for themselves as they will be assessed on their genuine interest to live and work in the province.

If an applicant's submission is successful, then the third stage is reached with the receipt of a nomination from the specified province. Once this has been achieved, the applicant can proceed to complete a separate application for Permanent Residency Status with Citizenship and Immigration Canada (CIC).

Living and Working in Canada under a PNP

The PNP are intended as one of the routes to permanent residency in Canada. One may compare them to Canadians work permits in that restrictions are imposed upon where the visa holder is permitted to work. Just as the Canadian work permit allows its holder to work for that specified company only, a Provincial Nomination requires the candidate to live and work only in the sponsoring province, not in Canada per se. A non-Canadian national residing in Canada through a PNP may only work outside their sponsoring province if and when they successfully apply to become a Canadian citizen.
